The MPs of the Legislative Chamber passed the Protection of the Population from Harmful Noise Exposure Bill Tuesday.
That had been the third time that the MPs reviewed. It was sent back for revision in August 2024, but failed to pass its second reading in September of this year.
The Bill has proposed to establishes new time frames during which disturbing the peace is prohibited. The nighttime quiet period has now been extended from seven to eight hours—from 11:00 PM to 7:00 AM, and from 10:00 PM to 9:00 AM on weekends and holidays, violating of which will result in fines.
Th eMP Bekmirza Eshmurzaev explained that the bill was revised following discussions. Provisions on coordination between the government and civil society, as well as certain clauses on the procedure for collecting compensation, have been removed; these provisions are already enshrined in other articles. while, the government will keep the authority to determine the size of compensation payments should harm to health be caused.
Compensation payments do not release violators from taking measures to prevent harmful noise impacts.
The Bill has clarified the powers of government bodies and increases liability for driving vehicles whose noise levels exceed established standards.
It now has a provision that construction and repair work that generates noise above the limit may only be carried out in apartment buildings on weekdays from 9:00 AM to 6:00 PM. The MP Eshmurzaev noted that such work shall not be deemed a violation in itself, as construction and repair are "natural processes," but a time frame must be set.
The Bill has also established a mechanism for suspending the operations of facilities that systematically exceed noise levels for a specified period.
Employees engaged in conditions where permissible noise levels are exceeded will receive increased wages in accordance with the Labor Code.
The Bill was passed by the MPs and has been sent to the Senate.
