Criminal case has been opened against the judges of Tashkent city criminal court Odilbek Ilhomjonov, Mirziyod Abidov and Mukhtarama Turgunova, as well as the Deputy Chairman of the Tashkent City Court/Chairman of the Judicial Criminal Board Murodjon Mirzajonov, the press service of the Prosecutor General's Office said.
According to the case documents, A. Shukurov was found guilty of a number of articles of the Criminal Code by the Mirzo Ulugbek District Court for committing the crimes of fraudulently acquiring another person's property in a large amount, hooliganism, and intentional infliction of grievous bodily harm, and was sentenced to 8 years and 1 month in prison.
The defendant A. Shukurov was dissatisfied with the above sentence, and his appeal to the court was considered by judges of the appellate instance O. Ilhomzhonov, M. Abidov, and M. Turgunova, who came to the conclusion that the verdict of the first instance court should be changed and replaced with a sentence of 3 years in prison, applying Article 57 of the Criminal Code.
However, the Deputy Chairman of the Tashkent City Court, M. Mirzajonov, took advantage of his official position to prevent the case from being considered comprehensively, completely and impartially, interfered in court proceedings and exerted unlawful influence on the judges. As a result, the judges, knowing in advance that his assignment was illegal and independent in the implementation of a fair trial and making decisions, did not adhere to the principle of the inevitability of liability, but changed the verdict of the court of first instance, applied Article 57 of the Criminal Code, replaced the sentence with a 3 years and 3 months of house arrest, and released him from prison from the courtroom, issuing an illegal and unfair verdict that caused grave consequences.
According to the above, within the framework of the criminal case, the former deputy chairman of the city court M. Mirzajonov and the former judges of the city court for criminal cases O. Ilhomjonov, M. Abidov and M. Turgunova were involved as defendants and a precautionary measure in the form of arrest was applied.
Currently, the preliminary investigation is underway by the Prosecutor General's Office.
